INTRODUCTION
This Privacy Policy describes how Metafonics AI Technologies ("Metafonics," "we," "us," or "our") collects, uses, shares, and protects personal information. This Policy applies to users ("you," "your") of our website, https://metafonics.com (the "Site"), and our AI-powered phone assistant services (collectively, the "Services").
Metafonics AI Technologies is a U.S. company with its principal place of business at 1750 Rogers Ave, San Jose, CA 95112, USA. It is affiliated with the Turkish entity Metafonics Yapay Zeka Teknolojileri A.Ş.
This Policy is designed to comply with applicable United States privacy laws, including the Federal Trade Commission Act (FTC Act), the Children's Online Privacy Protection Act (COPPA), the CAN-SPAM Act, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the California Online Privacy Protection Act (CalOPPA).
By using our Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use our Services.
1. DEFINITIONS
Personal Information: Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.
Sensitive Personal Information: A specific category of Personal Information, including but not limited to government-issued identifiers (like Social Security numbers), precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, the contents of a consumer's mail, email, or text messages (unless we are the intended recipient), and genetic or biometric data.
Service Provider: A third party that processes information on our behalf.
Third Party: Any entity other than Metafonics, our users, and our Service Providers.
2. INFORMATION WE COLLECT
We collect information in the following ways to provide and improve our Services:
2.1. Information You Provide Directly
This includes information you provide when you create an account, subscribe to our Services, or contact us for support:
- Identifiers: such as your full name, email address, phone number, and company name.
- Commercial Information: such as billing information, payment card details (processed by our third-party payment processors), and subscription history.
- Communications: Any information you provide when you contact us via email at info@metafonics.com or through other support channels.
2.2. Information Processed on Your Behalf
As an AI phone-assistant service, we process data that you and your customers generate when using the Services. This may include:
- Audio Data: Recordings of phone calls handled by our AI assistant.
- Communications Content: Transcripts of calls and any Personal Information or Sensitive Personal Information contained within those communications.
- Customer Data: Contact information (phone numbers) of individuals who interact with our AI assistant on your behalf.
When we process this information, we act as a "Service Provider" under the CCPA/CPRA, and our use of this data is governed by our agreement with you, our customer.
2.3. Information We Collect Automatically
When you use our Site or Services, we automatically collect certain information:
- Internet or Other Electronic Network Activity Information: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, and the dates/times of your visits.
- Usage Data: Information about how you interact with our Services, such as features used and performance metrics. This is collected through cookies and similar tracking technologies.
Google Ads measurement: when advertising measurement is permitted, our website reports clicks on WhatsApp links and the action that prepares a demo enquiry in WhatsApp to Google Ads. Google may receive page, browser and device information and advertising identifiers to measure and attribute ads and optimize campaigns. These events do not confirm that a message was sent, a conversation occurred or a customer purchased. We do not send the name, company or phone number entered in the demo form as conversion parameters. Details of Google's processing: https://business.safety.google/privacy/.
Anonymous US solutions activity: when measurement is permitted and our hosting service confirms a US country signal, we store the event type (page opening or WhatsApp link click), the fixed page path (/en or /en/solutions), country US and server receipt time in Lovable Cloud for aggregate reporting by Metafonics. No name, contact details, IP address, browser identifier, advertising click identifier or WhatsApp message content is stored in these event records. These events do not identify unique people, customers, sent messages or advertising attribution. Rejection in Cookie settings and Global Privacy Control block new records; unknown country signals are not recorded.
For visitors located in the United States, Google Ads measurement is on by default unless you opt out using the "Do Not Sell or Share My Personal Information" link or Cookie settings, or your browser sends Global Privacy Control. Everywhere else, including Türkiye and the EEA/UK/Switzerland, Google Ads is blocked until you accept advertising measurement. You can reject or later withdraw permission using Cookie settings; an explicit rejection is respected elsewhere too. We also honor Global Privacy Control by blocking advertising measurement. Your choice and the notice version, time and language are recorded in your browser; earlier acceptance evidence is retained when you withdraw. Messages you choose to send in WhatsApp are processed by WhatsApp under its own terms and privacy policy.
3. HOW WE USE YOUR INFORMATION
We use the information we collect for the following business and commercial purposes:

Upon termination of the purpose for which it was collected or upon your written request, we will take reasonable steps to either delete or anonymize your Personal Information in a secure and irreversible manner.
8. CHILDREN'S PRIVACY (COPPA)
Our Services are not directed to individuals under the age of 16. We do not knowingly collect Personal Information from children under 16. If we become aware that we have inadvertently collected Personal Information from a child under 16, we will take steps to delete such information from our systems promptly. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us.
9. MARKETING COMMUNICATIONS (CAN-SPAM)
We may send you marketing emails about our Services. In compliance with the CAN-SPAM Act, all marketing emails will include a clear and conspicuous "unsubscribe" link that you can use to opt out of future marketing communications. Transactional or service-related emails (e.g., billing notices, policy updates) are not subject to this opt-out.
10. "DO NOT TRACK" SIGNALS (CalOPPA)
Some web browsers may transmit "Do Not Track" (DNT) signals. Currently, there is no industry standard for how to interpret these signals. Therefore, our Services do not currently respond to DNT signals.
